These terms and Conditions are to be initialed on each page and signed and a copy scanned back to Amaya Explorer with the Booking Deposit thus both acknowledging that the guest understands said terms and by signing, agrees to the same.

Tips for crew: Although services will be performed wholeheartedly with or without tips, it is somehow expected in the local custom regarding gratuity. Tips will be compiled in a box and distributed evenly amongst 19 crews. It is not advised to give personal tips to a particular crew directly on board.

A. BANK ACCOUNT INFORMATION
Below is the information of the bank account necessary for making payments. Any payment made means customers agree to the terms and conditions. PLEASE BE AWARE THAT BANK CHARGES SHOULD BE PAID BY THE SENDER. WE SHOULD RECEIVE PAYMENT IN FULL AMOUNT. Please kindly confirm with us the bank account you intend to transfer the funds prior to making the payment.

B. DOWN PAYMENT
All bookings must be made by written mail and state the sailing dates, sailing destinations, number of confirmed passenger and if there are any special requirements. A 30% down payment is to be sent to PT.JELAJAH BAHARI MULIA, the bank account details of which will appear on the invoice upon signing a binding agreement. Deposit should be transferred at the latest 7 days after the invoice is received. 30% Down Payment is NON REFUNDABLE once it has been made. Please plan the sailing trip carefully before placing a deposit. We are not responsible for a bank transfer to account name other than PT.JELAJAH BAHARI MULIA. Please note that servicing and booking will not be secured until a deposit is received by Amaya Explorer or their agents.
C. REMAINING BALANCE PAYMENT
Full payment must be made at the latest 90 days before the departure date. Payment of the balance, including surcharges, extra cost (rental gear, private guide, extra fuel for sailing other destination, DAN insurance) must be made directly to Amaya Explorer 60 days prior to the departure date. If full payment of the balance is not received by this date, Amaya Explorer reserves the right to cancel the booking or the requested extras.
D. PAYMENT SHOULD BE NETT OF BANK CHARGE
Please be aware that bank charges should be paid by the sender. We should receive payment in full amount. Amaya Explorer is not responsible to the additional bank cost due to transfer made by clients for deposit or balance payment.
Any shortfall in amount received due to unpaid transfer charges, you will be notified, and will be collected at the end of your trip.
E. CANCELATION POLICY
Cancellation must be sent in writing via email to amayaexplorer@gmail.com
Cancellation is subject to payment the following fees:
If client cancel more than or 90 days prior to departure:
o 30% Down Payment cannot be refunded and will be kept as deposit. Only the same client is able to use it for other destination valid 2 years (start from date of cancellation). However, reschedule trip price is subject to increase according to the new price list on the requested reschedule year.
If client cancel between 89 to 60 days prior to departure:
o 30% Down Payment cannot be refunded and will be kept as deposit. Only the same client is able to use it for other destination valid 2 years (start from date of cancellation). However, reschedule trip price is subject to increase according to the new price list on the requested reschedule year.
o Cancellation fees 50% of total the remaining balance will not be refunded.
If client cancel less than 60 days prior to departure:
Cancellation fees 100% of the total remaining balance plus the down payment will not be refunded and will not be kept as deposit any longer.
Note: Amaya Explorer is not responsible for any additional bank cost due to transfer for refund payment.
If trip cancelled by KLM. Amaya Explorer/ PT. Jelajah Bahari Mulia for any other reasons that cannot be avoided, the management will immediately inform directly to the guests and any compensation provided will be in the form of future credits only (no refund).
Amaya Explorer strongly recommends its guests to purchase a trip Cancellation/interruption insurance to protect the travel investment at the time of contract signature the coverage will offset cancellation charges in the event of illness and if infected by COVID-19 before or during the trip. Such trip Cancellation/interruption as well as baggage insurance are available at travel agencies. Certain circumstances can occur that we cannot control such as bad weather or technical problems.
F. REFUND
No refund will be issued if a guest voluntarily or involuntarily does not show up for their trip, is denied boarding for any reason including failure to possess required travel documents, passport or visa or terminates his/her trip in progress.
If there is any refund process need to be made, the company will need a minimum of 60 days to start processing the case, and expect the refund to be transferred more than 60 days after the claim is received.
Refund amounts will be amounts paid according to the T&C, minus bank transfer fees.
G. CHECK IN AND CHECK OUT
Our check in time onboard is 6AM – 9AM. Check out time on the last day is at 11AM.
H. TUMBLERS
We urge customer to bring their own tumblrs for the trip as we would like to limit the use of plastic bottles onboard. If a customer did not bring their own tumblr, Amaya Explorer also provides tumblrs for sale (USD 25).
I. INSURANCE: DIVING OR TRAVEL INSURANCE
We encourage you to inquire about the travel insurance refund policy due to the unlikely event of cancelation of bad weather or technical problems. Passengers wishing to scuba dive must have diving insurance. This can be arranged at additional cost by Amaya Explorer. The cost is USD40 for short term DAN insurance policy. Guests requiring the above service must inform Amaya Explorer by electronic mail no less than 30 days prior to the commencement of the cruise date.
J. LOSS OF RENTAL EQUIPMENTS OR DAMAGE TO VESSEL PROPERTY
Should there be any damage or loss of property caused by the passenger to items belonging to or rented from the vessel, then the customer is required to pay for the loss.
K. PARTICIPANT RESPONSIBILITY
Guests are also responsible for studying all pre-departure information, for bringing all detailed equipment and clothing, for conforming to standards of personal hygiene to minimize the risk of traveler’s disease and for acting in manner considerate of fellow Guests and the countries visited. Guests are solely responsible for compliance with all of the laws and regulations of the countries visited.
By the paying the deposit, guarantees that all Guests are mentally and physically prepared for the itinerary, and aware of all risks associated with in water-activities and shipboard safety. All Guests wishing to dive will be required to provide proof of diving certification and some Guests undertaking scuba diving activities may be required to provide medical certificates, confirming their fitness to dive.
Guests are advised that smoking is not permitted anywhere inside or below deck onboard Amaya Explorer. And any damage to our furniture will be charge according to the furniture price to the guest after the trip, including materials burned due to cigarette fire.
Amaya Explorer reserves the right to cancel, refuse service to, or expel from the vessel any Guests displaying inappropriate behaviour, exhibiting medical issues that construe a safety risk, or for any other reason, at any time, during or prior to charter.
L. HEALTH AND FITNESS TO TRAVEL
The Passenger warrants that he/she is fit to travel by sea and that his/her conduct or condition will not impair the safety of the ship or inconvenience the other Passengers. Any passenger with a condition that may affect his fitness to travel is strongly encouraged to check with their personal physician regarding their ability to travel and to obtain a written physician's certificate of Passenger's fitness for an international sea voyage. If it appears to Amaya Explorer, the Cruise director in their sole discretion that a Passenger is for any reason unfit to travel, likely to endanger health or safety, or likely to be refused permission to land at any port, or likely to render the Company liable for Passenger maintenance, support or repatriation, then the Company or the Cruise Director shall have the right to take any of the following courses and the Company shall have no further liability to Passenger: (i) Refuse to embark the Passenger at any port; (ii) Disembark the Passenger at any port; (iii) Transfer the Passenger to another cabin; (iv) or to transfer the Passenger to a health facility at any port, all at the Passenger's expense. Passenger acknowledges that travel by sea involves certain risks and hazards including motion of the vessel by sea conditions, and the delay and/or impossibility of immediate evacuation from the vessel in the event of a medical emergency depending on the vessel's location and prevailing sea and weather conditions. The company shall have no liability and shall owe no full or partial refund in the event the Passenger is refused passage, disembarked, confined to the infirmary or their cabin, or transferred to another cabin pursuant to this section.
M. TIPS
Should the service and hospitality of our crew come as satisfactory for you, we welcome you to give the crew tips. Although this is not mandatory, the suggested tip amount is around 10% of price. Our crew will be very pleased with your appreciation and gratitude.
